Enabling legislation was signed by the Governor on
July 24, 2000, Commissioner's Regulations are in the process of being
drafted.
On 8/22/2000 Orange-Ulster BOCES was invited to attend
a meeting on Project SAVE in Albany at the SED. Attending were members
of SED, NYS Police, NYS Emergency Management, BOCES Health & Safety
Officers and the Upstate Center for School Safety. A follow-up meeting
was held 9/25/2000 in Albany.
New York's Lt. Governor held a Public Forum 9/27/2000
at the Middletown High School.
Items Below are REQUIRED by the legislation.
- Fingerprint prospective employees and send
2 sets of prints to SED.
- Develop a "Code of Conduct" for school
property.
- Codes of Conduct shall be adopted and filed with
SED.
- Assaults on teachers or staff at schools by anyone
will be increased to a Class D felony.
- A Violent Incident Reporting System shall be developed.
- Report child abuse in an educational setting in
writing.
- "Silent resignations" for child abuse
by staff will result in Class E felony against the superintendent.
- Courts are mandated to notify schools about juvenile
delinquency adjudications.
- Teacher removal of disruptive or violent pupils
from the classroom is allowable.
- Principal Authority to Suspend is allowable.
- A District-Wide School Safety Plan shall be developed.
- A Building-Level School Emergency Response Plan
shall be developed.
- A District-Wide School Safety Team shall be appointed.
- A Building-Level School Safety Team shall be appointed.
- A Building-Level School Post-Incident Response
Team shall be appointed.
- A Building-Level Emergency Plan shall be filed
with NYS Police and with the local law enforcement agencies.
- A Plan shall be filed with SED within 30 days
after adoption. Public comment is required 30
days before adoption.
- Interpersonal Violence Education & Prevention
Packages are required.
- Violence Prevention Training.
- Character Education (civility) is required for
grades K through 12.
- Whistle Blower Protection is provided for reporting
suspected acts of violence.
- Use of Evidence In Suspense Hearings even if not
admissible in court is allowed.
- Actions Upon Criminal Conviction still require
